Hottoly Terms of Service

These Terms of Service ("Terms") govern your use of Hottoly (the "Service") provided by Satoshi Yokokawa (MysteryLog) ("we", "our", or "us"). By using the Service, you agree to these Terms.

1. Scope

These Terms apply to all relationships between you and us regarding the Service. Any guidelines, notices, or help content published in the app or on our website form part of these Terms.

2. Service Description

The Service is a communication support app for sharing moods within family or close-member groups, including timeline, notifications, and story features. We may add, modify, or discontinue features at any time.

3. Eligibility and Accounts

• You are responsible for creating and managing your account.
• You must keep account information accurate and up to date.
• Unless caused by our willful misconduct or gross negligence, we are not liable for damage caused by unauthorized account use.

4. User Content and Rights

• You retain rights to text, emojis, images, videos, and other data you submit ("User Content") to the extent permitted by law.
• You grant us a non-exclusive, royalty-free license to use User Content as necessary to provide, operate, improve, secure, and support the Service.
• You represent that your User Content does not infringe third-party rights.

5. Prohibited Conduct

You must not:

• violate laws or public policy;
• infringe rights of others (IP, privacy, reputation, etc.);
• impersonate others or submit false information;
• attempt unauthorized access, reverse engineering, scraping, or excessive load;
• interfere with operation of the Service;
• cause harm or disadvantage to us or third parties; or
• engage in any conduct we reasonably consider inappropriate.

6. Subscriptions and Ads

• The Service includes free features and paid subscription features.
• Billing, renewal, cancellation, and refunds are processed via App Store / Google Play and RevenueCat, and are governed by those platforms' terms.
• Ads may be shown in the free plan.

7. Suspension and Interruption

We may suspend or interrupt all or part of the Service without prior notice for maintenance, incident response, third-party service failures, or other operational reasons.

8. Disclaimers

• The Service is provided on an "as is" and "as available" basis, without warranties of fitness, completeness, continuity, or error-free operation.
• The Service is not intended for medical diagnosis, treatment, or clinical decision-making.
• Unless caused by our willful misconduct or gross negligence, we are not responsible for disputes between users or with third parties.

9. Limitation of Liability

To the maximum extent permitted by law, our liability is limited to direct and ordinary damages, except in cases of willful misconduct or gross negligence. We are not liable for indirect, special, incidental, or consequential damages, including lost profits.

10. Enforcement and Account Termination

If you violate these Terms or if we reasonably determine that restrictions are necessary for operation or security, we may remove content, restrict features, suspend, or terminate your account without prior notice.

11. Changes to These Terms

We may revise these Terms when necessary. Revised Terms become effective when posted in the Service or on our website, unless otherwise required by law.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any dispute arising out of or in connection with the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
